1. Introduction
Welcome to View Rockies Charters ("Company," "we," "our," or "us"). By booking or using our charter bus services, you agree to comply with these Terms and Conditions. Please read them carefully.
2. Booking and Payment
2.1 Day Rate Bookings – Quotes are based on an 11-hour service day between an accommodation or rest period basis. Any additional time will be subject to an hourly rate added to the invoice. Maximum driving hours in Canada are 13 hours, and maximum on-duty hours are 14 hours. Drivers must have a continuous 8-hour off-duty rest period after 16 elapsed hours since their last off-duty period. If a driver shuttles a group to a venue and remains off-duty at a hotel/motel until the next pick-up, only then they are considered off-duty. Drivers will not break the law by exceeding these limits.
2.2 Reservations – All bookings must be made in advance and are subject to availability. A confirmed booking requires a signed agreement and a deposit.
2.3 Payment Terms – Full payment must be received before service is provided. We accept credit cards, debit cards, email transfer, cash payments.
2.4 Deposits – A non-refundable deposit of 10% is required at the time of booking to secure your reservation. Unless otherwise agreed, a full payment is required 30 days before the travel.
2.5 Late Payments – Late payments may result in booking cancellation or additional fees.
2.6 Cancellation & Refund Policy –
2.7 Quotes – All quotes are valid for a maximum of 72 hours and subject to vehicle and driver availability.
2.8 Last-Minute Bookings – Bookings made within 72 hours of departure are subject to availability and must be paid in full at the time of booking.
2.9 Overtime & Driver Switch – Overtime exceeding 15 minutes will be charged at $50 per half-hour increments. Federal and Provincial Hours of Service rules must be followed. Driver switching fee of $500 plus travel charges will apply if additional drivers are required.
3. Liability and Limitation of Responsibility
3.1 Company Liability – We are not liable for delays, service interruptions, weather conditions, road closures, or any unforeseen circumstances beyond our control. We are also not liable for lost, stolen, or damaged personal belongings.
3.2 Passenger Conduct – Passengers must follow all safety instructions from our drivers. We reserve the right to refuse service to anyone behaving in a disruptive or unsafe manner, without a refund. Any tickets/infractions issued to View Rockies Charters due to passengers' actions, will be passed on to the offending passenger(s) in question and passengers will be refused any further service.
3.3 Force Majeure – The Company shall not be responsible for failure to perform due to unforeseen circumstances, including but not limited to acts of nature, strikes, or government restrictions. Passengers should allow extra time for travel, especially during peak seasons.
3.4 Delays and No Shows – If passengers are delayed at the point of pick-up, the driver will wait for up to 30 minutes. After this period, an hourly waiting charge of $80 per hour will apply, or the booking may be canceled without a refund. If passengers fail to arrive at the scheduled departure point within the waiting period, the trip will be considered a no-show, and no refunds will be issued.
4. Damage, Cleaning Fees, and Additional Charges
4.1 Damage Responsibility – The client is responsible for any damage caused to the bus, its equipment, or furnishings by their group. Repair costs will be charged to the client.
4.2 Cleaning Fees – If excessive cleaning is required (e.g., spills, bodily fluids, trash left behind), an additional cleaning fee of $500 will apply.
4.3 Overtime Charges – If the charter extends beyond the agreed duration, additional fees will be charged per hour or fraction thereof. Even under overtime the driver cannot operate the vehicle for more than 13 hours in a work day.
4.4 Unscheduled Stops – Any additional stops requested outside of the agreed itinerary may result in extra charges.
4.5 Estimates – Charter pricing is based on mileage, route information, and hours of service charges. Deferred cleaning or refueling may also result in additional charges. Transport Canada regulations require itinerary reviews for compliance with hours-of-service rules. A finalized itinerary must be submitted at least 7 business days before dispatch, additional stops or delays may incur extra charges.
4.6 Service Area – Additional charges may apply for travel outside the radius of 35 Kms from the Calgary International Airport, including empty vehicle travel, mileage, and fuel surcharges.
4.7 Schedule Changes – Any schedule change requested within 48 hours of the trip, shifting the pick-up time by 2 or more hours, will incur additional charges.
4.8 Luggage – Passengers who refuse a reasonable search request may be denied service. No responsibility is assumed for lost or forgotten items on vehicles. Items found will be stored for 30 days and may be claimed during business hours.
4.10 Billing & Final Charges – All Charter services are subject to a final accounting audit. Post Trip Billing will reconcile actual mileage and hours of service and charge accordingly for any excess over the estimate.
5. Safety and Regulations
5.1 Contact Traveller – Valid day-of-service contact information must be provided with booking. The day-of-service contact is responsible for passenger conduct and any damages.
5.2 Seat Belts & Safety Rules – All passengers must remain seated while the vehicle is in motion. Passengers must wear seat belts where available and comply with all safety regulations.
5.3 Prohibited Items – The following are strictly prohibited on our buses:
5.4 No-Smoking Policy – All our vehicles are strictly smoke-free, and we enforce a no-carrying and no-use policy for any controlled substances.
5.5 Pick-Up & Drop-Off Locations – Pick-up and drop-off locations must be within a 30-kilometre radius of Calgary International Airport. If locations fall outside this radius, the time taken to drive back to the pick-up or drop-off point without clients will be counted as working time.
5.6 Underage Passengers - We require that an adult guardian accompany any young children under the age of 18 who are travelling in limousines and party buses.
5.7 Winter Weather Cancellation – Signature Charters reserves the right to cancel trips due to unsafe road conditions such as frigid temperatures, snowstorms, travel advisories, road closures or temperatures colder than -20°C.
5.8 Gravel / Unpaved Roads – With no exceptions we do not drive on gravel, unpaved or dirt roads for travel.
5.9 Overnight Driving – For safety and to prevent fatigue, drivers do not operate our vehicles between 2 am and 5 am. Itineraries must be adjusted for this, and accommodations must be provided for overnight stay.
5.10 Driver Rights – Drivers reserve the right to terminate service without refund if passenger behavior endangers safety.
6. Refunds and Dispute Resolution
6.1 Refund Policy – Refunds, if applicable, will be processed within 10 business days.
6.2 Dispute Resolution – Any disputes will first attempt to be resolved through negotiation. If unresolved, disputes will be subject to mediation or arbitration under the laws of Alberta.
7. Privacy and Data Protection
7.1 Personal Information – We collect and use your information only for booking and service purposes. Personal information collected through our website will not be sold or rented.
7.2 Security – We implement reasonable security measures to protect your data. Customers may request corrections or deletion of their data at any time.
8. Agreement and Amendments
8.1 Acceptance of Terms – By booking with us, you acknowledge and accept these Terms and Conditions.
8.2 Amendments – The Company reserves the right to modify these terms at any time. The latest version will always be available on our website.
